1. Our approach
We respect the rights of creators, and we expect every church using Displayte to do the same. Churches may only upload and show content they have the right to use. We respond to notices of alleged copyright infringement that follow the United States Digital Millennium Copyright Act (“DMCA”).
2. Reporting infringement
In short: Email our copyright agent with the details below. We’ll act quickly, and tell the church concerned.
If you believe content in Displayte infringes your copyright, send a written notice to our designated copyright agent at support@displayte.com with “Copyright notice” in the subject line. The notice must include:
- your physical or electronic signature, as the owner of the copyright or someone authorized to act for them;
- a description of the copyrighted work you believe is infringed;
- a description of the infringing material and where it is, detailed enough for us to find it (for example, the church and the file’s name, or where you saw it on screen);
- your name, address, telephone number and email address;
- a statement that you have a good-faith belief that the use isn’t authorized by the copyright owner, its agent or the law; and
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or are authorized to act for the owner.
When we receive a complete notice, we remove or disable access to the material, tell the church that uploaded it, and give it a copy of the notice. Knowingly misrepresenting that material is infringing can make you liable for damages.
3. Counter-notices
If your church believes material was removed by mistake or misidentification, an owner or admin can send a counter-notice to support@displayte.com including:
- your physical or electronic signature;
- a description of the material removed and where it was before it was removed;
- a statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification;
- your name, address and telephone number; and
- a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice or their agent.
We’ll send the counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they’ve filed a court action to stop the infringement, we may restore the material 10 to 14 business days after receiving the counter-notice.
4. Repeat infringers
In appropriate circumstances, we suspend or end the accounts of churches or people who repeatedly infringe others’ copyright.
5. A note for churches
Showing a song lyric, film clip or artwork in a service often needs a license, even in a church. Licenses your church already holds (for example, for song lyrics or for showing films) may cover some uses; check what they cover before you put something on a screen. Displayte doesn’t provide licenses for content.
